Chapter 3. Operations with cash currency and checks

3.1. In exchange offices the following types of operations with cash currency and checks are carried out:

3.1.1. Purchase of cash foreign currency for cash currency of the Russian Federation.

3.1.2. Sale of cash foreign currency for cash currency of the Russian Federation.

3.1.3. Sale of foreign currency cash of one foreign state (group of states) for foreign currency cash of another foreign state (group of states) (conversion).

3.1.4. Exchange of a banknote (banknotes) of a foreign state (group of states) into banknotes (banknote) of the same foreign state (group of states).

3.1.5. Replacing a damaged banknote (s) of a foreign state (group of states) with an intact banknote (s) of the same foreign state (group of states).

3.1.6. Replacing a damaged banknote (s) of a foreign state (group of states) with an intact banknote (s) of another foreign state (group of states).

3.1.7. Purchase of a damaged banknote (s) of a foreign state (group of states) for the cash currency of the Russian Federation.

3.1.8. Acceptance of banknotes of foreign states (group of states) and banknotes of the Bank of Russia, which raise doubts about their authenticity, for sending for examination.

3.1.9. Purchase of checks for cash currency of the Russian Federation.

3.1.10. Purchase of checks for cash foreign currency.

3.1.11. Sale of checks for cash currency of the Russian Federation.

3.1.12. Sale of checks for cash foreign currency.

3.1.13. Payment of checks in cash currency of the Russian Federation.

3.1.14. Payment of cash checks foreign exchange.

3.1.15. Reception for sending for collection of cash foreign currency and checks.

3.1.16. Acceptance of cash foreign currency for crediting to accounts using payment cards.

3.2. Authorized banks, branches of authorized banks, additional offices, credit and cash offices, operating cash offices outside the cash node and other internal structural units in addition to operations with cash currency and checks specified in paragraph 3.1 of this Instruction can also carry out the following operations with cash currency and checks :

3.2.1. Purchase of checks with crediting funds to accounts of individuals in foreign currency.

3.2.2. Purchase of checks with crediting funds to accounts of individuals in the currency of the Russian Federation.

3.2.3. Sale of checks at the expense of funds on accounts of individuals in foreign currency.

3.2.4. Sale of checks at the expense of funds on accounts of individuals in the currency of the Russian Federation.

3.2.5. Acceptance of cash foreign currency for the transfer from the Russian Federation on behalf of physical person   without opening a bank account (with the exception of postal transfers).

3.2.6. Acceptance of cash currency of the Russian Federation for transfer from the Russian Federation on behalf of an individual without opening a bank account (with the exception of postal money transfers).

3.2.7. Payment of cash foreign currency transfers to the Russian Federation without opening a bank account in favor of an individual.

3.2.8. Payment of cash currency of the Russian Federation on transfers to the Russian Federation without opening a bank account in favor of an individual.

3.2.9. Acceptance of banknotes of foreign states (group of states), causing doubts in their authenticity, to verify their authenticity.

3.2.10. Acceptance of damaged banknotes of foreign states (group of states) for crediting to accounts of individuals.

3.2.11. Acceptance of cash foreign currency for crediting to accounts of individuals in foreign currency.

3.2.12. Acceptance of cash foreign currency for crediting to accounts of individuals in the currency of the Russian Federation.

3.2.13. Acceptance of cash currency of the Russian Federation for crediting to accounts of individuals in foreign currency.

3.2.14. Issuance of cash foreign currency from accounts of individuals in foreign currency.

3.2.15. Issuance of cash foreign currency from the accounts of individuals in the currency of the Russian Federation.

3.2.16. Issuance of cash currency of the Russian Federation from the accounts of individuals in foreign currency.

3.3. The operation specified in subparagraph 3.1.8 of this Instruction is mandatory for authorized bank (branch of an authorized bank).

3.4. Registration of operations for receiving (issuing) cash foreign currency and the currency of the Russian Federation using payment cards is carried out in accordance with the regulations of the Bank of Russia governing these operations.

3.5. Authorized banks, branches of authorized banks, additional offices, credit and cash offices, operating cash offices outside the cash center and other internal structural divisions must be equipped with a stand that is accessible for individuals to view and contains, in addition to the information specified in paragraph 2.1 of this Instruction , information on the procedure and conditions for effecting money transfer operations from the Russian Federation as per established by an authorized bank (branch of an authorized bank) a guarantee of individuals without opening a bank account, certified by the signature of the head of the authorized bank (branch of the authorized bank) and sealed with an impression of a round seal of the authorized bank (branch of the authorized bank).

3.6. The procedure and conditions for the transfer of funds from the Russian Federation on behalf of individuals without opening a bank account, as well as the obligations of an authorized bank (branch of an authorized bank) to transfer funds are established by an authorized bank (branch of an authorized bank) in accordance with the requirements of the legislation of the Russian Federation and regulations of the Bank of Russia.

Information on the procedure and conditions for the authorized bank (branch of the authorized bank) to transfer funds from the Russian Federation on behalf of individuals without opening a bank account, placed on the stand in accordance with paragraph 3.5 of this Instruction, is considered communicated and accepted by the individual signing a document for the transfer of funds.

Authorized banks (branches of authorized banks) carry out operations on the transfer of funds from the Russian Federation on behalf of an individual without opening a bank account on the basis of a document submitted by an individual. The form of the document intended for filling and submission by individuals when transferring funds from the Russian Federation without opening a bank account is established by authorized banks (branches of authorized banks) provided that the specified document contains all the necessary details for transferring funds.

3.7. Authorized bank   (a branch of an authorized bank) independently resolves the issue of the need to work with a coin of foreign states (group of states) when conducting transactions with cash and checks.


Cash foreign currency has no circulation in the territory of the Russian Federation. The implementation of settlements and payments in it is prohibited by the current Russian legislation on currency regulation   and currency control (3). At the same time, it is prohibited to export from Russia over the established minimum amount the currency of the Russian Federation - rubles. Therefore, non-residents who come to Russia, as well as residents and non-residents leaving it, are required to make currency exchange transactions for payment on the territory of a foreign state in the relevant currency. Their commission in the Russian Federation is entrusted to authorized banks, which for this purpose open foreign currency exchange offices. The discovery of the latter is registered in the GTU of the Central Bank of the Russian Federation at the location of the authorized bank. The exchange office can be opened at the cash office of the bank, as well as outside it. Creation of an item is issued by order of the bank. The following currency exchange transactions are performed in it: # x2011;
- purchase and sale of cash foreign currency for cash rubles;
- purchase and sale of payment documents in foreign currency for cash rubles, as well as for cash foreign currency;
- reception for sending for collection of cash foreign currency and payment documents in it;
- acceptance for examination of foreign currency banknotes and payment documents in foreign currency, the authenticity of which is in doubt;
- issue of cash foreign currency on credit and debit cards, as well as its acceptance for crediting to accounts of individuals in banks, settlements on credit and debit cards;
- exchange (conversion) of cash foreign currency of one foreign state for cash foreign currency of another foreign state;
-the exchange of a banknote of a foreign state for payment banknotes of the same foreign state;
-the replacement of the non-payment banknote of a foreign state with a payment banknote of the same foreign state;
- purchase of non-payment banknotes of foreign countries for cash rubles.
The bank can make all or some of the listed currency exchange transactions.
The purchase rate and selling rate of cash foreign currency and payment documents in it for cash rubles, as well as the cross # x2011; the exchange rate (conversion) of cash foreign currency are set by banks independently. At the same time, in order to regulate the domestic foreign exchange market in Russia and limit the size of currency and exchange rate risks, the Central Bank of the Russian Federation may set a deviation limit for the purchase rate of cash foreign currency and payment documents in foreign currency for cash rubles from the selling rate, as well as a deviation limit for buying and selling rates the exchange rate of foreign currencies against the ruble set by the Central Bank of the Russian Federation.

The procedure for authorized banks to conduct cash transactions with individuals, as well as the procedure for recording these operations by authorized banks, is set out in Bank of Russia Instruction No. 113-I of April 28, 2004 “On the Procedure for Opening, Closing, and Organizing Exchange Stations and Authorized Banks certain types of banking operations and other transactions with cash foreign currency and currency of the Russian Federation, checks (including traveller's checks), the nominal value of which is indicated in foreign currency, with the participation of individuals "1. Operations with cash currency and checks can be performed by exchange offices, additional offices, credit and cash offices, operating cash offices outside the cash center and other internal structural divisions of the credit institution2. However, most of these operations are performed in the exchange office. the cover of the exchange office the necessary documents for this, namely: notification; duly certified copies of documents confirming the ownership (lease, sublease) of an authorized bank (branch of an authorized bank) to the building (room) in which the exchange office is located; Layout of premises for placement of a credit institution with explication (size of occupied space and purpose of premises) and other documents. The territorial office of the Bank of Russia at the place of opening of the exchange office within two weeks from the date of receipt of these documents prepares an opinion on the compliance of the premises for performing valuables with the requirements established by the regulatory acts of the Bank of Russia and sends it to an authorized bank (branch of an authorized bank).
If the documents submitted by the authorized bank comply with the requirements of the legislation, the territorial office of the Bank of Russia at the place of opening of the exchange office shall enter information about the exchange office of the authorized bank (branch) in the State Credit Institutions Register. The exchange office is entitled to start work only after receiving a positive opinion from the territorial office of the Bank of Russia at the place of opening the exchange office.
A letter of refusal to issue a positive opinion to an authorized bank (branch) is made by the territorial office of the Bank of Russia at the place of opening the exchange office in an arbitrary form indicating the grounds for the refusal and sent to the authorized bank (branch) not later than two weeks from the date the territorial office of the Bank of Russia receives the notice on the opening of the exchange office.
Reasons for closing the exchange office are:
The adoption by the management body of an authorized bank (branch) to which this right is granted by the charter of an authorized bank (branch regulations), the decision to close the exchange office.
The issuance by the Bank of Russia of an order to revoke a banking license from an authorized bank.
The issuance by the Bank of Russia of an order to cancel a banking license from an authorized bank.
The publication by the Bank of Russia (the territorial institution of the Bank of Russia) of a directive on the introduction of restrictions on the conduct of banking operations with foreign currency by an authorized bank.
The publication by the Bank of Russia (the territorial institution of the Bank of Russia) of a prescription to impose a ban on banking operations with foreign currency by an authorized bank.
The exchange office must be equipped with a stand that is accessible for individuals to view and contains the following information and documents:
Name, address and telephone number of the authorized bank (branch of the authorized bank) that opened the exchange office.
The mode of operation of the exchange office.
The list of certain types of banking operations and other transactions with cash foreign currency and currency of the Russian Federation, checks, carried out by this exchange point.
Foreign exchange rates to the currency of the Russian Federation and cross-rates of foreign currencies used in transactions with cash and checks.
Information for appeals and complaints of individuals related to the work of the exchange office.
Extract from the tariffs of the authorized bank (branch) on the amount of commission charged for performing operations with cash currency and checks.
A copy of the positive conclusion of the territorial office of the Bank of Russia at the place of opening of the exchange office.
Rules of acceptance by an authorized bank (branch) of damaged banknotes of foreign states (group of states).

Issuance of cash foreign currency or cash currency of the Russian Federation from accounts using payment cards. Transactions in cash and checks are carried out by the exchange office only with the foreign currency, the rate of which is set by the Bank of Russia against the currency of the Russian Federation. At the same time, the list of foreign currencies with which the authorized bank (branch) performs these operations is determined by the authorized bank (branch) independently. When executing operations with cash and checks, exchange offices are obliged to identify the individual being served at the exchange office in accordance with paragraph 1 of Article 7 of the Federal Law “On Counteracting Legalization (Laundering) of Proceeds from Crime and the Financing of Terrorism”. Transactions with cash currency and checks can be carried out upon presentation by an individual to the cash worker of the exchange office of a driver's license.
The beginning of a transaction with cash currency and checks is considered the moment when an individual transfers a cash exchange office, cash, checks, payment cards necessary for carrying out a cash currency and checks, as well as one of the identity documents of an individual to a cash worker.
By accepting banknotes of a foreign state (group of states) from an individual or checks, the cashier of the exchange office uses reference materials as well as operational information of the Bank of Russia to determine whether the banknotes of a foreign state (group of states) are accepted as a means of payment in the territory of the foreign state (groups of states), as well as the authenticity of the said banknotes of a foreign state (group of states) and checks. In this case, the cashier of the exchange office and the individual should be provided with the opportunity to communicate and visually monitor the reception and recalculation of cash and checks.
During the implementation of operations with cash currency and checks, the cashier of the exchange office fills in the electronic Register of transactions with cash currency and checks.
The end of a transaction with cash currency and checks is considered to be the transfer of cash currency, checks, payment cards and a document confirming a cash currency transaction and checks to an individual by a cash worker. An authorized bank (branch) may charge a physical person a commission for carrying out operations with cash and checks in accordance with the rates set by the authorized bank (branch) independently. An authorized bank (branch) does not have the right to set in transactions with cash currency and checks: restrictions on the dignity (face value) and year of issue of banknotes of foreign states (group of states) in circulation;
restrictions on the amount of purchased (accepted) and sold (issued) foreign currency in cash, with the exception of coins of foreign countries (group of states), and restrictions due to actual balances in cash currency of the Russian Federation and in foreign currency held by the cashier of the exchange office;
different rates of foreign currencies depending on the dignity (nominal value) of banknotes of foreign states (group of states).
An authorized bank (branch) is not entitled to carry out restrictions on dignity (face value) and year of issue of Bank of Russia banknotes in circulation, in terms of the amount of purchased (accepted) and sold (issued) cash currency of the Russian Federation, when carrying out operations with cash currency and checks. The exchange office is prohibited to perform operations only on the purchase or only on the sale of cash foreign currency for the cash currency of the Russian Federation during an operational day, except for cases when the cashier exchanges the cash point of advances in cash foreign currency or cash currency of the Russian Federation, respectively. The operation of accepting for examination the banknotes of foreign countries, the authenticity of which is in doubt, is mandatory. Foreign currency banknotes and payment documents in foreign currency, which cause doubts about their authenticity or have obvious signs of forgery, are not returned to the bearer and are to be detained by the bank and issued to the bearer a certificate of acceptance for examination of a cash ticket of a foreign country (payment document in a foreign currency) causing doubt his authenticity. If the examination recognizes the authenticity of a foreign country’s banknote (payment document in foreign currency), the banknote of a foreign country (payment document in foreign currency) may be returned to the client, the equivalent in cash rubles paid or the corresponding amount in foreign currency or in rubles may be credited to customer accounts in the bank. The banknote of a foreign country or a payment document in a foreign currency recognized by the examination as non-genuine, is not returned to the bearer and is subject to delivery to the internal affairs bodies. A duly executed copy of the examination certificate is transferred to the bearer of an unauthentic foreign currency banknote or payment document in a foreign currency upon his request.
